• Jalopnik picks up on BenzBoost story regarding Evosport and Evosport threatens legal action

      One of the largest auto blogs on the net, Jalopnik, has been monitoring our story with Evosport. Things have gotten very heated as of late when Evosport had their attorney, Todd Serota, threaten my father as well as myself with legal action. BenzBoost was given a deadline and told to pull down the articles, looks like we missed it.

      BenzBoost finds Evosport's tactics of covering this story up and threatening us with legal action just rather sad. Instead of going about this professionally, Evosport has been closing threads on MBworld and deleting any mention of it. Since they can not do that on BenzBoost, they have sent their attack dog lawyers after us in an attempt to control things here as well.

      We will not be intimidated or budge from doing what is in our users and the consumers best interest. Consumer advocacy is something we need more of, not less. Mr. Serota, people like you are the problem in this country trying to keep the truth hidden and not having the integrity to do what is right. BenzBoost had the courage to reveal the details of what was taking place and did so accurately. Amazingly, you reached the wrong conclusion but we would not be surprised you would jump to whatever conclusion your clients would want you to jump to.

      You have done the opposite of quieting this down, only making major blogs take notice of it. Aren't you only digging the hole deeper for your own clients? BenzBoost is not afraid of you and not all that impressed with your scare tactics. Plus, aren't you a patent lawyer? Maybe you should stick to that as we can write a much harsher letter than what you provided.

      Also, threatening my 73 old year old father is flat out despicable. We are saddened that Evosport seems to endorse harassing senior and retired family members over forum posts they can not control. This does not reflect well on any company and does not reflect well on you as an attorney. If people wonder why attorneys get a bad name, it is due to actions such as this.

      At this point, it should be clear to you it is impossible to get this story removed as you have now served to propagate it. Well done Evosport and well done Mr. Serota. In our opinion, you have completely mis-managed this situation. Good luck prosecuting the entire internet, it does not seem the Evosport budget will allow for it.

      We have posted the legal documents Jalopnik obtained aimed at BenzBoost here, you can all review them for yourselves and see the lengths Evosport is willing to go to keep the truth from users on MBworld as well as consumers. BenzBoost will continue to do investigative reporting in the best interest of our users and all individuals in the German automotive performance industry.

        Turns out the attorney is Brad's friend who does driving events with Brad: http://www.digest.net/bmw/archive/v8/msg07383.html

        I have received numerous tips, and I can't substantiate if this is true, but have been told that he supposedly will write legal documents for Brad in exchange for parts and so forth. They are buddies and he would organize driving events as you can see from the link. I believe he owned a company called tracquest which he apparently sold.

        Seriously, though this $hit is ridiculous, wow, if they just spent half the time getting orders out instead of silencing and scheming, they wouldn't have any of these problems.

        Thank you, I appreciate that, but I don't think it will come down to it, at least I hope not.

        Evosport is responsible for this situation and brought this all upon themselves. By silencing the community from speaking about it and closing threads on MBworld they only increased the curiosity surrounding the events.

        Actually, this situation seems to be doing a lot of good as Evosport is really putting in the effort to resolve JRCART's situation so that is one plus. They also seem to be trying to deliver orders now and are communicating better with customers who have been waiting months on end. I have to ask though, where was this effort before the article?

        Why try to keep this all quiet instead of maybe using it as motivation and resolving it professionally?

        I promise you guys I will not protect vendors, my interest is in protecting the members here who are the buying public. Members first, as it should be.

        I don't think anything can come of it either.

        My wife is a very successful lawyer and we have good friends throughout the country who are incredible lawyers in different fields.
        We're great friends with one of NJs top personal injury law firms--my wife went to law school with the founders daughter who is also a partner at the law firm.
        And my brother in-law is living in Mendocino CA right now with his family and he's starting his own practice (he's a constitutional attorney), so I can surely refer a great "attack dog" of your own if the time comes.

        I don't think it will result in much more than scare tactics from these flamers, plus, like you stated before, there's really no wrong doing on your part, just uncovering facts and reporting what others have said.

        I'm really losing any little respect I had left for Evosport and the people associated with them.

        As am I. Their attorney is stating I have some kind of malicious intent yet he forgets the years of business I gave them? The thousands of dollars? The referrals? The positive reviews? Using my vehicle in their advertisements? They just conveniently forget all of that?

        As an attorney, I just want to say that letter Mr. Serota wrote is the most unprofessional and condescending cease and desist letter I have ever seen. It also appears that Mr. Serota's representation of Evosport is extra-curricular and not in the capacity of his legal practice. This is evidenced by his MIT alumni email address in his letterhead, which I might add is the most douchey thing I have ever seen in an attorney letterhead. Nobody cares where you went to school, brah. I could also point out his FAIL at giving notice by not sending this letter CERTIFIED MAIL, but I will refrain from mentioning that, since it could just be that Mr. Serota is just too frugal to spend about $6 to get a green card back. Oops. It looks like I mentioned it. Also, sending said cease and desist letter to a relative of this website's registered owner in a harassing manner is absolutely unacceptable. Stick to your mediation practice, Todd. You give us attorneys who really practice law a bad name. I'm appalled by the closing paragraph in this letter. This guy is lucky I don't send this to the CA Bar grievance committee for review. What a d-bag.

        Mr. Serota is confusing factual reporting with disparaging comments. He also fails to realize the factual information posted by bimmerboost.com WAS PUBLISHED by EVOSPORT and was sent out prior in a solicitation.

        You didn't know that is typical of MIT grads? I mean, after all, MIT is the best school EVER. The rest of us are lacking a proper education.

        I'm not sure if I should even be discussing the school in English as perhaps it is too "common" of a language and I do not have an orchestra playing the school anthem in reverence as I type about it.

        I've been reading this thread with great interest, being a vendor to Evosport and having done a few projects with them, including for board members here.

        Wherever you sit on this issue, please don't judge many excellent people in the community based soley on association with a shop that is involved in controversy. Remember that there are many great customers, vendors and employees associated with any supplier, and try and judge them independently of how the management and ownership may have acted.

        Neel, you have done a lot of great projects and worked with a lot of people on some very memorable cars. I don't think in any way, shape, or form, any of this will reflect on you.

        If anything, you have a great reputation and the members here who have purchased your services and dealt with you all speak highly of you and Apex Speed Technology. Evosport has had a relationship with a lot of tuners, suppliers, and companies over the years and those entities are in no way associated with this and I want to make that perfectly clear.

        Thanks Sticky! This is a funny business; sometimes you have to work hard to stay above the fray. On the other hand, I firmly believe that success is easier when you put integrity first, so its really less hard work than being dishonest or misleading.

        I agree with you completely but the more time I spend covering this industry the more I see integrity in general seems to be lacking. Very few have it, but there are those like you who do.

        Serota also said Mr. Wilk has a prior relationship with Evosport and "pretty much threatened" them while trying obtain something for the company. Nevertheless, Mr. Serota says "it has nothing to do with Mr. Wilk personally, he happened to be the one who did this."

        What's the "pretty much threatened" bit all about (if we may be so bold to ask)?
